Kelly falsified documents in X's files for two more years after the four plainclothes, possibly armed Gardai, forced their way into our home. To date Sean Kelly has never been questioned by An Garda Siochana, a Detective did try in 2009 but Kelly ran away.
Somebody had to be accountable for the warrant. I needed a copy to see who had authorised it and why.
I sincerely hope that this complaint will be investigated fully, failing that, I assure you that no amount of intimidation or harassment from those in your command will frighten me into withdrawing my civil action against Sean Kelly and state agencies.
Three days later on the 31st of October the Garda Complaints Board wrote to X:
He (Assistant Chief Executive) is of opinion that your complaint is vexatious. Accordingly the Board will take no further action in relation to your complaint.
An Garda Siochana did not want us to see the warrant. Superintendent Pat Lambe said it was nothing to do with Ashbourne Garda Station. A Superintendent in the National Drugs Unit promised to phone me back on it but he didn't. Written requests to both were likewise ignored.
On the 31st of October 2003, X also received a letter from Garda HQ which stated:
It would be inappropriate for the Commissioner to become involved.
On the 4th of November 2003, X wrote back to the Garda Complaints Board and asked how exactly could an accusation of 'Vexatious' be summarily leveled against her without any corresponding investigation. X also made a new Data Access request to An Garda Siochana, it was imperative to find out where the 'vexatious' accusation was coming from. X's access request was returned to her at least four times in November and December 2003, An Garda Siochana simply refused to accept it.
On the 17th of December 2003, X wrote to the Data Protection Commissioner, Mr. Joe Meade. She requested an appointment to discuss the harassment and intimidation she had been subjected to since her complaint was upheld against An Garda Siochana. X also informed Joe Meade that An Garda Siochana were refusing to accept her current access request
On the 5th of January X wrote to the Garda Commissioner in his position as the Registered Data Controller for An Garda Siochana. X enclosed the following letter:
Ill founded and without merit.
The tone of the language coming from Garda HQ had changed from ignoring and laughing to fighting talk. As I said in a previous blog, An Garda Siochana fight dirty. I genuinely believe and know first hand that the vast majority of rank and file Gardai are honest hardworking people doing a thankless job, but their diligence is squandered by politically motivated high ranking movers and shakers to whom honesty is an anathema.
On the 16th of January 2004, the office of the Data Protection Commissioner wrote to X. In this letter, X was informed that the Commissioner would not meet with her to discuss the harassment and intimidation she had been subjected to resulting from her Access Request. The other astounding admission from Data Protection was that it was now Garda Policy to return access requests they deemed 'incomplete'. This 'Policy' from An Garda Siochana renders all access request figures published as worthless.
On the 27th of February I wrote to the then Minister for Justice, Mr. Micheal McDowell. I outlined in great detail what had and was happening to X and in particular the harassment and intimidation by An Garda Siochana. I forwarded a copy to the Garda Complaints Board.
On the 4th of March, X wrote again to the Garda Commissioner. She enclosed a copy of the extensively detailed submission I had sent to McDowell and the following covering letter:
For two months nothing happened and then on the 16th of July 2004 the Garda Complaints Board wrote to X and informed her that her complaint which had been dismissed out of hand as 'Vexatious' was, in fact, admissible and that an Investigating Officer would be appointed.
Despite the movement, An Garda Siochana still refused to hand over a copy of the warrant. The longer it went the more I suspected that it was a dodgy warrant, and I was soon to be proven correct.
